Park Shelter Reservation Fee Policy

Purpose


Parks which are open to the public without the payment of a fee or other consideration are within the purview of the recreational user immunity statute provided under Ohio law. This policy has been established in order to protect, to the greatest extent possible, the immunities provided under State law to cities which own and operate public parks which include park shelter facilities. In adopting and following this policy it is expected that future legal arguments relating to this immunity will be greatly solidified, particularly where there has been an injury in a member-owned or operated park shelter.

Policy Statement

Effective January 1, 1994, it is the policy of the Miami Valley Risk Management Association that its cities forego the payment of any reservation fee, rental fee, deposit, or other type of financial transaction or exchange for the reservation or use of park shelters within member-owned or operated public parks.

Effective September 22, 2003, if a member municipality collects a fee of any nature for the use of a park shelter within member owned or operated public parks, said member municipality shall self-insure the first $25,000 of any such loss incurred.
